You’ve Been Given A Building Violation – Now What?

If you’re a property manager in New York City, the day will come when you need to handle a building violation. Most often prompted by a complaint from a tenant or neighbor, the DOB will inspect a building and issue a violation if the building is not in compliance with standards.

The five most common building violations issued in New York City are 1) lack of heat or hot water 2)No carbon monoxide or smoke detectors 3)windows & doors that require a key to exit 4)mold & pests 5)ADA lack of accessibility.

For any type of building violation, the cure is to have the issues fixed by a licensed, qualified professional, pay the DOB fines, and provide proof of both to the DOB. Most violations are Class A, which means you have 90 days to fix the problem. If for some reason, there’s hazardous waste involved, that’s a class B violation, and the timeline is shorter. If your property violations include lead paint or window guards, you will have 3 weeks to address the issue.

Gas Lines & Local Law 152

As a property manager in New York City, you are no doubt aware that the city requires regular inspection of gas lines in all buildings except single and two story family homes. These inspections must occur on an every 4 year basis. If they don’t happen – or if an inspection reveals a problem with your gas lines – a building violation will be issued until the situation can be properly resolved. Gas line concerns are handled by licensed master plumbers.
